1. Acceptance of Terms
By accessing or using the services provided by Telemetry Insights, LLC ("Company," "we," "us," or "our"), including our website at https://www.telemetryinsights.com, mobile applications, IoT monitoring platform, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
2. Description of Services
Telemetry Insights provides IoT-based monitoring solutions including but not limited to water leak detection, foundation monitoring, irrigation management, and building automation. Our Services include hardware devices, cloud-based software platforms, mobile applications, and related support services.
3. Account Registration
To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscriptions and Billing
Some Services require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select. You authorize us to charge your payment method for all fees due. Subscriptions automatically renew unless canceled before the renewal date. Refunds are handled in accordance with our refund policy.
5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the Services in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to any part of the Services; (c) interfere with or disrupt the Services or servers; or (d) reverse engineer, decompile, or disassemble any part of the Services.
6. Intellectual Property
All content, features, and functionality of the Services, including but not limited to software, text, graphics, logos, and trademarks, are owned by Telemetry Insights, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
7. Hardware and Devices
Hardware devices purchased from Telemetry Insights are covered by our standard warranty. Devices are intended for indoor or outdoor use as specified in the product documentation. Improper installation, misuse, or unauthorized modification may void the warranty. The Services require an active internet connection and compatible hardware to function properly.
8. SMS Messaging Terms
By opting in to receive SMS notifications from Telemetry Insights, you consent to receive text messages related to your account and devices. These messages may include:
- Device alerts (water detection, temperature, connectivity)
- Account notifications (subscription, billing, payment)
- System status and maintenance updates
- Operational alerts for team administrators
Message frequency varies based on your account activity, alert settings, and device configuration. Customers with active devices may receive up to 30 messages per month depending on alert thresholds. Message and data rates may apply. Consent to receive SMS is not a condition of purchase.
You may opt out at any time by replying STOP to any message. Reply HELP for assistance or contact us at support@telemetryinsights.com. Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and US Cellular. Carriers are not liable for delayed or undelivered messages.
9. Limitation of Liability
To the maximum extent permitted by law, Telemetry Insights, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Services are monitoring tools and are not a substitute for professional inspection or insurance coverage.
10. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or that alerts will be delivered in all circumstances. Internet connectivity, power outages, and environmental conditions may affect device performance.
11. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. You may cancel your account at any time through your account settings or by contacting support. Upon termination, your right to use the Services ceases immediately.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Union County, Georgia.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
